Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy supplements our Privacy Policy. It applies to "consumer health data" as defined by the Washington My Health My Data Act, Nevada Senate Bill 370, and similar laws, and to health-related "sensitive data" under other state privacy laws.
1. What consumer health data we collect
Because we sell hair and scalp care products, some information we collect could identify or suggest a health condition, such as:
- The fact that you viewed, added to cart, or bought a product related to hair thinning or scalp care;
- Information you choose to give us about your hair, scalp, or health in customer service messages, reviews, photos, or guarantee and warranty claims;
- Information about a reaction or side effect you report to us.
2. Sources
We collect this data directly from you, and automatically from your use of the Site (for example, pages viewed and orders placed).
3. Why we collect and use it
- To provide the products and services you ask for: processing and delivering orders, customer service, returns, guarantee and warranty claims;
- To meet legal obligations, including reporting serious adverse events to regulators when required;
- To prevent fraud and keep the Site secure;
- To understand how the Site is used and fix problems (analytics), through analytics tools that act on our behalf and record the pages and products viewed. In Washington and Nevada, we do this only with your consent;
- Only with your separate consent: to personalize marketing using health-related information (for example, emails or ads that show or recommend the specific hair or scalp care products you viewed, added to your cart, or bought), or to measure advertising with it.
4. Who we share it with
We share consumer health data only with: Shopify (platform and checkout), payment providers, fulfillment partners and shipping carriers, and our order tracking, email, customer service, reviews, and analytics providers (all acting as our processors, for the purposes in section 3), and with regulators or authorities when required by law. We do not share consumer health data with advertising partners without your separate consent, and we never sell consumer health data. We set up our advertising tools so that they do not receive the names, IDs, or page addresses of the specific hair and scalp care products you view, add to your cart, or buy, and in Washington and Nevada they run only after you consent.
5. Your rights
You have the right to:
- Confirm whether we collect, share, or sell your consumer health data, and access it, including a list of all third parties and affiliates with which we shared it and their contact information;
- Withdraw consent at any time;
- Have your consumer health data deleted (including from our processors' systems);
- Appeal our decision on your request. If we deny your appeal, you may contact the Washington State Attorney General at https://www.atg.wa.gov/file-complaint or the Nevada Attorney General.
How to exercise your rights: email privacy@hairecover.com with the subject "Health Data Request." We respond within 45 days (extendable once by 45 days when reasonably necessary, with notice). We will not discriminate against you for using your rights.
